These terms govern your use of the MinMax app for iPhone and iPad ("the app"), operated by KGH Analytics LLC ("we", "us"). By downloading or using the app, you agree to them.
MinMax helps you find meals at U.S. fast-food chains near you that fit a calorie cap you set. It builds each suggested order from the chain's menu items and ranks orders by most protein or most filling.
Calorie, protein, and other nutrition values come from nutrition information the chain publishes itself or, for some chains, from a third-party table, which the app labels "Third-party". Every order shows where its numbers came from and when they were checked; see Nutrition Sources. We do our best to keep this data accurate but cannot guarantee it. Recipes, ingredients, and nutrition vary by location and over time.
MinMax is not a medical, dietary, or nutritional service. The suggestions are not medical advice. Do not use the app as a substitute for professional guidance from a physician, dietitian, or other qualified provider. If you have a medical condition, allergy, dietary restriction, or are pregnant, consult a qualified professional before relying on any information in the app. MinMax does not provide allergen information; check allergens with the restaurant.
MinMax displays the names and logos of third-party fast-food chains, and the names of their menu items, for the sole purpose of identifying the restaurants and items the app shows. We are not affiliated with, endorsed by, or sponsored by any of these chains. All third-party trademarks and brand assets remain the property of their respective owners.
We grant you a personal, non-exclusive, non-transferable license to use the app on Apple devices you own or control, subject to Apple's App Store terms. You may not:
MinMax does not have accounts. Your calorie cap, recent places and chains, and trips are stored on your device. Your usuals and hidden restaurants are stored on your device and, if you're signed in to iCloud, in your private iCloud storage so your devices match. You may delete all of it at any time from the app's menu → About & privacy → Delete all MinMax data. What the app sends, and to whom, is described in the Privacy Policy.
The app relies on services from Amazon Web Services (including Amazon Location Service), Apple (iCloud and Apple Maps), PostHog, and Google AdMob. Their availability is outside our control, and outages may make some features temporarily unavailable. Directions open in Apple Maps, which is governed by Apple's terms.
MinMax is free to use. It shows one non-personalized ad from Google AdMob as the last row of the nearby results list. Ads are provided by Google and its advertisers; we do not endorse the products or services they advertise.
We may add, change, or remove features at any time. We may also discontinue the app or any of its features without notice. If we materially change these terms, we'll surface it in the app's release notes.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT NUTRITION INFORMATION DISPLAYED IS ACCURATE OR COMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KGH ANALYTICS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100).
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Delaware.
The app is distributed through Apple's App Store. Apple's App Store Terms of Service also apply. Apple is not a party to these terms and is not responsible for the app or its content.
